Mathews files suit against Bay Aging for handling of home elevation grant

The County of Mathews has filed a complaint against Bay Aging in Mathews Circuit Court, claiming a case for “contribution, equitable indemnification, fraud in the inducement, fraud, and constructive fraud.”

The suit stems from Bay Aging’s contract with the county to administer and serve as the construction manager for four FEMA Hazard Mitigation Grant Program elevation projects beginning in 2009.

One of those projects, for the home of Wade and Susan Brooks of Mathews, resulted in a 2011 lawsuit against both Mathews County and the contractor who handled the project, HHM LLC of Tomahawk, Kentucky. In 2013, the Brookses prevailed in the case against HHM LLC, but have been unable to collect damages awarded by the court, while the case against the county has remained in limbo for four years.

In February, the Brooks family lost their home to foreclosure.
