Marshall in court on bond hearing

Mathews Circuit Court was packed Wednesday morning with members of a local church whose member, Kenneth Scott Marshall, 36, of Marsh Hawk Road, Mathews, was there for a bond hearing.

Marshall, previously identified by the Mathews County Sheriff’s Office as the church’s youth leader, was indicted July 16 on felony charges of aggravated sexual battery of a minor through the use of mental incapacity or physical helplessness and forcible sodomy of a minor through the use of mental incapacity or physical helplessness.

Defense attorney Stephen A. Dunnigan moved to continue the bond hearing until 9:30 a.m. on Aug. 22 because he wanted a witness who was not present to testify. Judge Jeffrey W. Shaw granted the continuance. Several additional witnesses were called forward to swear that they would be present at the later date.

No trial date was set for Marshall’s case, said Commonwealth’s Attorney Tom Bowen, because the defendant has not yet hired a trial attorney...
