G.I. couple to appeal court ruling

Gwynn’s Island property owners Mark and Candy Eubank of Doswell have notified Mathews Circuit Court that they will appeal the court’s ruling against them in last year’s appeal of decisions made by the Mathews County Board of Zoning Appeals.

The Eubanks’ attorney, Brenton J. Bohannon, made the comment to the court in a letter filed in January.

Retired Judge William H. Shaw III, in a letter filed with the court on Dec. 18, had ordered the Eubanks to remove additions to their cottage at the corner of Sweet Gum Drive and Old Ferry Road.

Shaw was acting on two appeals—one from Mr. and Mrs. Eubank challenging the BZA’s denial of two additions for which they had filed after-the-fact variance permit requests, and the other from the Mathews County challenging the BZA’s approval of two different additions for which the Eubanks had filed similar after-the-fact requests.

No date for a hearing on the appeal was mentioned in the correspondence. ...
