The U.S. Department of Justice filed a statement of interest in federal court Tuesday in connection with a federal lawsuit brought by a transgender Gloucester High School student against the county school board.

In the lawsuit, filed in June by the ACLU on behalf of the student, 16-year-old Gavin Grimm seeks to use the boys’ restrooms at GHS. Grimm was born a girl but identifies as a boy.

The GHS administration initially allowed Grimm to use the boys’ restrooms last fall. After parents expressed strong objections, the Gloucester School Board adopted a policy in December restricting the use of school restrooms to corresponding biological genders. 

The policy also states that students with identity issues will be provided with an alternative private facility. After the policy was passed, Grimm was told to no longer use the boys’ restrooms and three unisex, single-stall restrooms were installed at GHS.
