Suit filed against Gloucester School Board

A transgender Gloucester High School student has filed suit against the Gloucester County School Board alleging that its restroom use policy “inflicts severe and persistent emotional and social harm” on him and is discriminatory.

The suit says the policy, which limits male and female restroom use to corresponding biological genders and provides for alternative facilities for students with gender identity issues, treats the student differently based on his gender.

The suit was filed last week in federal court by the ACLU and the ACLU of Virginia on behalf of GHS student Gavin Grimm. It seeks to require the board to allow Grimm to use the male restrooms at GHS, along with unspecified damages.

Grimm, 16, has been diagnosed with gender dysphoria, according to the suit, which is “characterized by significant distress caused by incongruence between a person’s gender identity and the person’s assigned sex at birth.”
