Planners to hold public hearing on code amendment tonight

The Gloucester County Planning Commission will hold a public hearing virtually tonight for a potential code amendment regarding modifying the language for nonconforming lots involved in Boundary Line Adjustments (BLAs).

Though county supervisors previously approved revisions to the code amendment last November, staff’s concern about the language is a result of a BLA not approved since it did not conform to the requirements even though it would likely be supported by the planners and permitted by supervisors.

According to the notice of public hearing, “The proposed change to the Subdivision Ordinance will clarify the definition of ‘Boundary Line Adjustment’ within the types of applications regulated by the Subdivision Ordinance by defining a ‘Boundary Line Adjustment’ as the rearranging or straightening of property lines of contiguous parcels where no additional lots are created. The proposed changes to the Zoning Ordinance will allow the flexibility provided to Boundary Line Adjustments containing nonconforming lots of record to also apply in situations where the nonconforming lots are not contiguous to each other.”

Other business

Planners will also review updated departmental policies and provide staff with feedback. According to planning and zoning documents, “with the adoption of the revisions to the Subdivision Ordinance for updating platting requirements, we were able to eliminate five of the policies, interpretations and explanations that staff have been using and that were posted on the Planning and Zoning webpage.”

Policies that staff decided to update to reflect changes to the ordinances since they were developed include Average Lot Width, Private Road Requirements for Non-Residential Lot, Proof of Access for Private Roads, and Special Events.

Also up for discussion is the zoning ordinance update on open space, buffers, HOPs and general development standards reviews and public comments concerning chicken keeping and big box retail/distribution centers.

Staff will present on the zoning ordinance amendments rewrite to the planners. According to planning and zoning documents, “In March we will review the items still unresolved and provide you with staff’s recommendations related to updated open space definitions, when and if the required setback buffer area can be included in open space calculations, minimum size of an open space parcel, and the percentage of open space required for multifamily/attached single family developments.”
