Unclear how new guidance from President Trump will affect Grimm case

It was not clear this week how new guidance from President Donald Trump’s administration would affect a Gloucester transgender student’s federal lawsuit against the county school board. 

The U.S. Departments of Justice and Education issued the new guidelines in a “Dear Colleague” letter dated Feb. 22. Those guidelines rescinded guidelines issued by the departments on May 13, 2016 under the administration of former president Barack Obama.

The guidance issued last year states that Title IX and its implementing regulations prohibit sex discrimination in educational programs and activities operated by recipients of federal financial assistance. “This prohibition encompasses discrimination based on a student’s gender identity, including discrimination based on a student’s transgender status,” the letter states.
