Marshall sentencing postponed

The sentencing of Kenneth Scott Marshall of Mathews, which had been scheduled for Wednesday, Jan. 8, has been postponed until Feb. 12 by Mathews Circuit Court Judge Jeffrey W. Shaw.

During a brief hearing Wednesday morning, Mathews County Commonwealth’s Attorney Tom Bowen told the court that the psycho-sexual evaluation he had requested for Marshall, and that the judge had then ordered, was not performed until Tuesday morning, and that it would be 30 days before the written report would be available.

Both Bowen and defense attorney Jason Atkins said they would prefer to go forward with the sentencing on Wednesday, but Shaw said he had ordered the evaluation and that it would be a waste of resources not to consider the report when making his decision.
