Hayes homeowners seek county rule waiver

The Gloucester County Planning Commission has received a request from a homeowners’ association at Hayes to waive the requirements for a sidewalk and streetlights there. The matter will be considered tonight at 7:30 in the colonial courthouse.

Hawthorn Green Homeowners Association is seeking the waiver as 16 out of 17 lots in the subdivision, located off Lillaston Lane, have less than 20,000 square feet of area and less than 125 feet of road frontage. The county’s subdivision ordinance said that lots less than 20,000 square feet or 125 feet of road frontage are required to have both sidewalks and streetlights.

Anne Ducey-Ortiz, director of planning and zoning, said in a Dec. 29 memorandum to the commission that the commission approved this subdivision, with a sidewalk and streetlights, in May 2005. However, she noted the subdivision ordinance allows the commission to waive requirements of the ordinance if they are determined to be unnecessary.
