Gwynn’s Island property owners’ suit against county dismissed

A suit alleging malicious prosecution and abuse of process filed by Gwynn’s Island property owners Mark and Candy Eubank against Mathews County Administrator Mindy Conner and former employees John Shaw and Susan Thomas was dismissed with prejudice Friday by retired Circuit Court Judge William H. Shaw III.

In a hearing held in Gloucester County Circuit Court, attorney Saemi Murphy, representing the county employees, asked Judge Shaw to require the Eubanks to include certain documents in their complaint that they had asked to suppress: The original Notice of Violation the county issued regarding zoning violations on the Eubank property and the summonses that were issued to each of the Eubanks when they didn’t respond to the notice.

Attorney Brenton Bohannon of the firm Bohannon & Associates, PLLC, representing the Eubanks, said those documents were not essential to the complaint, but Murphy said that suppressing them would “put blinders on the court.” In their complaint, the E...
