Court rules Grimm allowed to use boys’ restroom as case proceeds

A federal district court judge granted a preliminary injunction last Thursday that would allow a transgender Gloucester High School student to use the restrooms designated for the sex he identifies with while his discrimination lawsuit against the Gloucester School Board continues.

The student, Gavin Grimm, was born female but identifies as a male. He sued the Gloucester School Board last year, claiming its policy restricting restroom use to corresponding biological genders is discriminatory under Title IX and the 14th Amendment. The board’s policy additionally requires alternative, private facilities for transgender students.

With his discrimination claim, Grimm sought a preliminary injunction that would allow him to use the boys’ restroom while his case proceeds. 

During the first hearing on the matter, U.S. District Court Judge Robert Doumar dismissed the Title IX claim and denied the injunction. He allowed the 14th Amendment claim to go forward.
