Bay Aging files response to home elevation suit

Bay Aging has filed a response in Mathews Circuit Court to a complaint made against it by Mathews County. The county’s complaint seeks to include Bay Aging in the Wade and Susan Brooks home elevation case, but Bay Aging has denied the allegations made by the county and has asked that the court dismiss the third-party complaint and award the agency its costs.

The Brookses filed suit in 2011 against the county and the contractor who worked on their home after a grant-funded FEMA elevation project left them unable to obtain an occupancy permit. Bay Aging acted as the agent for the county on the project. The Virginia Board for Contractors found against the contractor, as did Mathews Circuit Court. However, the court case against the county was continued and has been on hold for four years.
