Horton, developer) to amend the Gloucester County Zoning Map to reclassify +/-130.8 acres of 169.635 acres (consisting of part or all of Tax Map numbers 32-17, 17L, 22, 25, & 31: RPC #41273, 44917, 21430, 27606, & 13693) from RC-1, Rural Countryside and B-1, General Business (conditional pursuant to Rezoning Application Z-97-01), to PUD-1, Planned Unit Development (conditional pursuant to Rezoning Application Z-25-02) with a portion of the parcels to remain zoned RC-1 and B-1 (conditional pursuant to Rezoning Application Z-07-01). The purpose of the application is to develop 214 townhouse (attached) units and 213 single-family (detached) units in two phases (with Phase 1 containing 272 total units, including 134 townhouse units and 138 single-family units, and Phase 2 containing 155 total units, including 80 townhouse units and 75 single-family units). However, as permitted in Proffer 6 of the proposed Proffer Statement, the total number single-family units may be increased up to 293 units as long as the total number of townhouse units is decreased proportionally. The property is located in the Abingdon Magisterial District along Foxmill Centre Parkway (SR 1076) with access to Route 17 South. The Comprehensive Plan identifies this area as Highway Mixed Use and Mixed Density Residential within the Development District and the Gloucester Court House Village Plan identifies this area as Business Mixed Use and Mixed Residential Expansion. The Development District is intended to be the County’s principal population center and most suitable area for new population growth while minimizing impacts on local roads. Furthermore, within the Highway Mixed Use and Mixed Density Residential designations, identifiable places defined by form (instead of use) containing a variety of housing types, including higher-density, village-scale development served by public water and sewer with sidewalks, street trees, street lighting, open space, compatible development patterns, and access management standards can be appropriate. The Business Mixed Use and Mixed Residential Expansion designations are intended to contain increasing amounts of residential uses with a mixture of dwelling types that are well-connected to adjacent commercial areas along Route 17. In addition, higher densities may be appropriate in conjunction with pedestrian-oriented features, green areas, parks, and appropriate infrastructure, so long as these densities are also compatible within the context of existing adjacent development patterns. The PUD-1 District is intended to allow for more unique and flexible arrangements in site planning and development than permitted through land use requirements within other zoning districts. The applicant has submitted a Proffer Statement containing PUD Ordinance requirements, which will establish the zoning requirements for this development. However, where the PUD Ordinance does not describe a zoning requirement, the development is subject to the applicable requirements within the Zoning Ordinance. The applicant has also submitted other voluntary proffers regarding consistency with a master plan, individual cash proffers for school improvements (on a per unit basis) as well as fire department and public water capacity upgrades (both on a one-time basis).
